Welcome to Dakota Nonprofit Alliance (“we,” “our,” or “us”). These Terms of Use (“Terms”) govern your access to and use of our websites, raffle platforms, fundraising tools, live drawings, events, and related services (collectively, the “Services”).

By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, you may not use the Services.

1. Eligibility

You must be at least 18 years of age to participate in raffles, fundraising activities, or any transaction through Dakota Nonprofit Alliance.

By using the Services, you represent and warrant that:

You are at least 18 years old
You have the legal capacity to enter into these Terms
You are complying with all applicable local, state, and federal laws

2. Nature of the Services

Dakota Nonprofit Alliance provides a technology platform and administrative support for:

Charitable raffles and fundraising activities
Live and recorded drawings
Entry management and reporting
Payment processing through third-party providers

Dakota Nonprofit Alliance does not provide legal, tax, or financial advice.

3. Raffles and Fundraising Activities

All raffles and fundraising activities are subject to:

Applicable state and federal laws
Official rules disclosed for each raffle or event
Participation requirements set by the sponsoring nonprofit

By entering a raffle, you agree to abide by the posted rules for that specific raffle.

Odds of winning depend on the number of eligible entries received.

4. Payments and Entries

All payments are processed through third-party payment processors.
Dakota Nonprofit Alliance does not store full payment card or banking information.
Entries are not transferable unless expressly stated in the raffle rules.
All purchases are final unless otherwise required by law.

Dakota Nonprofit Alliance reserves the right to void entries that are incomplete, fraudulent, or submitted in violation of these Terms or applicable law.

5. No Guarantee of Winnings

Participation in raffles or fundraising activities does not guarantee any prize or benefit. All prizes are awarded as described in the applicable raffle rules.

Dakota Nonprofit Alliance is not responsible for:

Incorrect contact information provided by participants
Failure to claim prizes within specified timeframes
Technical issues beyond reasonable control

6. User Conduct

You agree not to:

Use the Services for any unlawful or fraudulent purpose
Attempt to manipulate or interfere with raffle outcomes
Access systems or data without authorization
Submit false, misleading, or inaccurate information
Disrupt the integrity or operation of the platform

We reserve the right to suspend or terminate access for violations of these Terms.

7. Intellectual Property

All content on the Services, including text, graphics, logos, software, videos, and platform functionality, is owned by or licensed to Dakota Nonprofit Alliance and is protected by intellectual property laws.

You may not copy, reproduce, distribute, or exploit any content without prior written permission.

8. Third-Party Services

The Services may rely on or link to third-party providers, including payment processors, streaming platforms, or email services.

Dakota Nonprofit Alliance is not responsible for the availability, performance, or content of third-party services and disclaims liability for their actions.

9. Disclaimers

The Services are provided on an “AS IS” and “AS AVAILABLE” basis.

To the fullest extent permitted by law, Dakota Nonprofit Alliance disclaims all warranties, express or implied, including but not limited to:

Merchantability
Fitness for a particular purpose
Non-infringement

We do not guarantee uninterrupted or error-free operation of the Services.

10. Limitation of Liability

To the maximum extent permitted by law, Dakota Nonprofit Alliance shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Services.

Our total liability for any claim related to the Services shall not exceed the amount paid by you, if any, for participation in the applicable raffle or event.

11. Indemnification

You agree to indemnify and hold harmless Dakota Nonprofit Alliance, its officers, directors, partners, affiliates, and service providers from any claims, damages, liabilities, or expenses arising out of:

Your use of the Services
Your violation of these Terms
Your violation of any applicable law

12. Termination

We may suspend or terminate access to the Services at any time, with or without notice, for conduct that violates these Terms or is harmful to the platform, participants, or partner organizations.

Termination does not affect rights or obligations that accrued prior to termination.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of South Dakota, without regard to conflict-of-law principles.

Any disputes shall be resolved exclusively in state or federal courts located in South Dakota.

14. Changes to These Terms

We reserve the right to modify these Terms at any time. Updated Terms will be posted on this page with a revised effective date. Continued use of the Services constitutes acceptance of the updated Terms.
